Terms and Conditions for eVA

1. Agreement
These Terms and Conditions constitute a legally binding agreement between ePathUSA Inc, located at 1075 Jordan Creek Parkway, Suite 295, West Des Moines, IA 50266, and the customer or user accessing eVA.
By accessing or using eVA, you agree to these terms.
2. Service Description
eVA is provided as a cloud hosted software service that delivers AI assisted conversational and knowledge support capabilities.
3. Account Responsibilities
Customers are responsible for:
- Maintaining the confidentiality of account credentials
- Managing authorized users and permissions
- Ensuring usage complies with applicable laws and internal policies
4. Subscription and Billing
Subscription plans, pricing, and billing terms are defined through:
- Direct agreements with ePathUSA Inc
- Microsoft Commercial Marketplace subscription terms where applicable
Marketplace purchases are additionally governed by Microsoft marketplace policies.
5. Availability and Support
While ePathUSA Inc targets high availability, the service is provided on an as is and as available basis.

6. Intellectual Property
All software, branding, trademarks, and service content remain the exclusive property of ePathUSA Inc.
Customers retain ownership of their uploaded data.
7. Limitation of Liability
To the maximum extent permitted by law, ePathUSA Inc shall not be liable for indirect, incidental, or consequential damages arising from use of eVA.
8. Termination
ePathUSA Inc may suspend or terminate access for violations of these terms or the Acceptable Use Policy.
9. Governing Law
These terms are governed by the laws of the State of Iowa, United States.
